    sponsored by local governments, would give local governments, and mobilehome park residents, more tools to protect mobilehome parks and existing rent control protections. GSMOL will be working to ensure the bill addresses the needs of residents.

    ** AB 566 (Nava) Mobile Home Park Conversion Requirements - When converting an existing mobilehome park to private ownership, the Subdivision Map Act requires subdividers to obtain a survey that gauges the mobile home park resident's support for the proposed conversion. AB 566 takes this requirement one step further by requiring a majority of the residents of a mobile home park to demonstrate support for the parks conversion to private ownership. As introduced, the bill also permitted local agencies to enact ordinances to prevent "sham" conversions and preserve affordable housing.

Yet your begging is not enough because their land now is different from 20 years ago due to its appreciation and the increasing  population.  If 20 years ago they invite you to live in their park forever, then now they sell their park, convert their park to condominium ownership and evict your family without any compensation under State Governor support. This conversion requires evictions to all of the mobilehome tenants, disregard  the Detrimental Reliance/Estoppel doctrine. No one want to buy it; still you must pay the unlimited new higher rent until you cannot afford and abandon your home.  They don't like minority of poor, retirees, non-working, handicapped, unemployed families, including your children. ......     Schwarzenegger vetoed AB566 yesterday, saying he didn't like the idea that cities could take the views of residents into consideration and turn down a conversion if most residents
    oppose it -- even if ALL residents oppose it.

    We have just learned the unfortunate news that the Governor has vetoed AB 566.  Of course, we all greatly disappointed. Those living in parks where conversions are pending or the threat of conversion is looming desperately need the
    protections that this bill would provide.

    "I am returning Assembly Bill 566 without my signature.
     
    While the intent of this bill is to preserve low-income housing, the fact that a majority of mobilehome park residents do not support a conversion is not an appropriate means for determining the legitimacy of a conversion.  The law is not intended to allow park residents to block a request to subdivide.   
     
    For this reason I am unable to sign this bill. "

     
  • Schwarzenegger funny thinking is that he is afraid the home owners to block the park owners, but he allows the park owners to block home owners  to sell their mobile home by increasing rent unlimitedly and because of ""why buy a home in a park where it could convert to condo's tomorrow."  (pdf)

    The park owners lose nothing in any situation, even if they cannot convert to condo. Still, the residents will lose their mobile home sooner or later. 
    Schwarzenegger does not know that the higher the space rent the lower the value of the mobilehome. He mistakenly treat the mobile home owners as tenants who have no property, basically the same as if they were renting an apartment. And when the conversion begins it will disregard the Detrimental Reliance/Estoppels doctrine. 

    The mobilehome owners lose their property because they wrongly believe the park owners promise/make them believe that they could rent the space forever or at least a long term. They wrongly believed that they would be compensated for their property if the park owners do not keep their promise.

    In fact, the Schwarzenegger  allows the park owners to rob their mobile home property with high rent, unable to sell, and unable to sublease. The mobile home owners lose the
    hope that they can ask the park owners compensate their property by "requiring a majority of the residents of a mobile home park to demonstrate support for the parks conversion to private ownership."

                        
    Any healthy thinking person can see that the park owners could persuade a majority of residents for the conversion with an appropriate compensation based on  the Detrimental Reliance/Estoppels doctrine.  Yet, now with the veto, the park owners do not need to persuade or follow  the Detrimental Reliance/Estoppels doctrine.  Moreover,  nobody/no attorney wants to bring them to justice for only $2000, the maximum amount specified in the" Civil Code Sec. 798.86 Management Penalty for Willful Violation 46." This law created by legislators for the purpose to prevent in advance any attempt to sue their boss. How about DOJ? Forget about it. They are established for fighting games between rich people and for the tyranny of majority of rich and middle income level.

    Think about this: "If the increase  tax up to 90% on rich people must require a majority vote, then I am not sure how this governor can make a decision with his funny face"  This is an example for how the meaning of majority in a democracy society can deter the future injustice. Unfortunately, the majority requirement is nothing for Schwarzenegger. I guess that he graduated with an extra honor master degree from China or a Ph.D from North Korea.

AB 761, a very dangerous bill that would allow huge rent increases when manufactured homes in rental communities are sold, passed out of the Assembly Housing Committee and could be taken to a vote of the entire Assembly at any time. AB 761 is a dangerous bill that would remove the protections of rent control at the time of sale, and allow the park owner to increase the rent to the next purchaser. Increased rents result in decreases in the MH sales price. This will also lead to a domino effect that will impact homeowners in non-rent controlled areas, as well.

Why allow the park owner to negotiate the rent to the next purchaser? The answer is that: "Based on supply and demand, land owners need money to improve the park (even though, the cost has been included in the rent). If manager increase 30% on the space rent for the next purchaser, then nobody wants to buy.  So, they will auto adjust to 20% then 10% .... So they need to have the right to interfere with the sale...  so  and so... "

It is the most intellectual explanation because if no body wants to buy the mobile home, park managers lose nothing.  Land owners lose nothing.  Yet, home owner cannot sell the house, cannot tolerate the high rent, cannot escape the park ....  He/she will abandon the house sooner or later.  Park managers and land owners happily, unfairly, unethically get the extra benefits from the abandoned house as a gift to improve the park.  In other words, Land owners do not need to adjust the negotiation price for the next purchaser. What they really/secretly need is to increase, increase, and increase the space rent  forever under the protection of the law, legislators, governor, state, county, local government, Department of Joke, and even the judges.

In fact,  Land Owners do not need the AB 761 (it allows the park owner to increase the rent to the next purchaser)  because they have implemented the 10% increase for the next purchaser  as long as 30 years ago disregard State written law and still apply this 10% until today. It does not matter for the AB 761 need to confirm or legalize their act.

They do not need to legalize their unjust enrichment and they do not worry about their unfair/unethical pratice because no attorney wants to receive only $2000 to bring their scam /unjust enrichment /injustice /criminal to court

I believe that Sacramento is under control by young female/male lobbyists who receive salary from land owners and the rich.  To win this battle, instead of hiring attorneys we should hire young beautiful/handsome lobbyists. There are a lot of young people drop out of college. Their fresh/ beauty/ innocent/ first-time lobbying  will defeat the fat/ old /stink lobbyists  and change the law.  We do not need the court system any more as long as people cannot close their eyes to the beauty. It may be easier to give them $2000 to change assembly/ officer/ senator's decision than to hire an attorney.  Lobbyists should replace the law and court system; and they really reduce enormous cost/deficit for US.

Description: Would require mobilehome parks to develop, implement, and post an emergency and fire safety plan; would allow cities and counties to adopt more stringent regulations.

SB 804 (Leno)  Leno, Mark SUPPORT -Passed the Senate (28-6). Referred to Assembly Housing and Judiciary; to be heard in Asm. Housing on July 8th. Description: Would prohibit a park from requiring a homeowner, who is replacing a mobilehome or manufactured home on a space in the park, to use a specific broker, dealer, or other person as an agent in the purchase or installation of the replacement home.

SB 111 (Correa)  Correa, Lou SUPPORT - Bill passed Assembly Housing (4-2) and is now pending on Assembly Floor. Urge your Assemblymember to Support. Description: Would reorganize the MRL to clean it up and make it more user-friendly by combining certain related sections and cleaning up other portions of the code.

Description: Would provide that a mobilehome that is not owner-occupied would not be subject to local rent controls

AB 566 (Nava) -
Pedro Nava Dem 35th  SUPPORT - Failed passage by one vote June 23 in Sen. Transportation & Housing Committee, granted reconsideration. Expected to be reheard July 7, 2009. Description: Would require that the currently-mandated survey of residents of a park slated for conversion to condominiums demonstrate that a majority of the residents support the conversion. The bill also would state that localities may enact reasonable measures to prevent sham conversions or to preserve affordable housing.

(Calderon) - Charles M. Calderon Dem  OPPOSE - Passed off Assembly Floor on June 25th, upon re-consideration. Expected to be referred to Senate Judiciary Committee. Hearing date unknown. Description: Would impose vacancy de-control restrictions on local mobilehome rent control ordinances. Upon a sale or vacancy of a mobilehome, the space rent would be set by the park, at market rate (i.e., "vacancy decontrol"). The bill would destroy billions of dollars of homeowner equity.

AB 869 (Mendoza) -  Tony Mendoza Dem 56th SPONSOR - Bill will be taken up in January. Description: Would create a program of certification for, and continuing education of, mobilehome park managers.

AB 1108 (Fuentes) - Felipe Fuentes Dem 39th SUPPORT - Passed Senate Utilities Committee. Headed to Senate Appropriations. Urge your member to support. Description: Would make various changes to requirements when electric or gas utilities are provided to mobilehome park residents and residential tenants through a master meter, including the following: (1) would allow the Public Utilities Commission to order repairs and maintenance of system; (2) Directs that the rate differential received by park owners be directed toward maintenance and repair; and (3) Would limit late fees on utility bills.

Olga pointed out that the rent-controlled residents owned their mobile homes, were responsible for maintaining their homes, and so also had property rights that needed to be protected.  "If a homeowner or former homeowner of a park is the prevailing party in a civil action, including a small claims court action, against the management to enforce his or her rights under this chapter, the homeowner, in addition to damages afforded by law, may, in the discretion of the court, be awarded an amount not to exceed two thousand dollars ($2,000) for each willful violation of this chapter by the management .."  (Amended by AB 693 (Corbett), Ch. 98 (2003), eff. 1/1/04)

They lose only $2000; even though they take million dollars from thousand mobile home owners for unfair charge 5%,10% on increase rent, transfer title, and abandoned houses. Their unjust enrichment is not only one year as Property Tax nor one time as Sale Tax, but from month to month, year to year, increase forever, never decrease for deflation or economic downturn, and the unjust enrichment keep going from the beginning day of establishment the park; and after 30 years it still increase. 

They lose only $2000; even though their managers' extreme/ outrageous conduct intentionally/ recklessly cause severe emotional distress on your family from month to month, and year to year.

"He blocked sales saying homes would be dragged around the park, threatening and shouting abuse at people. It was absolutely horrendous," she said.

Because of "not to exceed two thousand dollars ($2,000) " no attorney wants to bring this scam/crime/fraud to justice.  Their smart law from  the land owners' legislator kills any attempt/dream from local city and the court as it could happen in the past:

Such mobile home law you can see in any communist or tyrant regime to protect their party members.  It also happens in US as fathers of US Constitution predicted the oppression era by the tyranny of the majority of rich and middle income on the minority of poor retirees, non-working, handicapped, unemployed families, including your children.

The majority of rich and middle income, strong, talented, well educated, intelligent, smart, witty, high skill .... learn so much about how to coerce/oppress/abuse the minority of weak, poor, and disabled people.  They should learn one important lesson instead of all what they have learned:  "The veil of ignorance"

However, the California Mobile home Residency Law kills the property right of the homeowners by restricting sublease:

798.23.5 SUBLEASING
"" A homeowner shall be permitted to rent or sublet pursuant to paragraph (1) if a medical emergency or medical treatment requires the homeowner to be absent from his or her home and this is confirmed in writing by an attending physician... "

" The minimum term of the rental or sublease shall be six months, unless the management approves a shorter term, but no greater than 12 months, unless management approves a longer term. " ....

By restricting sublease (798.23.5) and exempting on rent control (798.17) the California Mobilehome Residency Law 2009 kills the property right of the homeowners. This allows for the park owners to steal the value and in other words to rob mobile homes from innocent people. The law makers mistakenly treat the mobile home owners as tenants who have no property, basically the same as if they were renting an apartment.

All of them, land owners, legislators, government, judges do not need to know that the higher the space rent the lower the price of the house for sale.

The land owners, the rich, the middle, or  the tyrant majority acted as if  they created the earth. The land is not belong to the nation or human or sentient beings. It is belong to them as long as 2000 years ago before their ancestors were born.  They can do whatever on their land because they bought/purchased the land from 1cent/sq.ft and now it worths $150/sq.ft. They can rent the land for any high price. Imagine when the majority of rich and midle income buy all of the land on the earth. If you do not have a space to live, or cannot bear their high charge, then go to the sea. You are second human.

It may be the reason for the communists to be alive after killing 200 millions people.  And there will be another killing for billions with a new tech/bio invention available for anyone. I believe that most of people kill each others not because they understand, misunderstand, or do not understand the idea of communism, socialism, capitalism, the idea of god, or something intellectual .... but because of their hatred and willing to revenge.  Their hatred comes from their frustration, despair,  hopelessness under the tyrant minority as well as majority ... day by day, month by month .... grow up little by little ... cannot stop ... cannot alter/change ... like terrorists or Timothy McVeigh.  Such hatred people do not want to live. The problem is that they want to die not alone but want to pull others to die with them as in Modern suicide bombing.

Do I commit a Slippery Slope argument? Wait and see.  I just believe that the adoption of one injustice policy will lead to the adoption of another injustice.
